1. Agreement

By accessing winonterms.com you agree to these Terms. If you do not agree, do not use the site.

2. What this site is

This site describes an educational real estate mentoring program. It is not an offer to sell securities, not an investment offering, and not real estate brokerage. We do not represent buyers or sellers in real estate transactions.

3. Enrollment

Purchasing through this site does not by itself enroll you. Enrollment requires a separately signed Mentoring Agreement, which contains the full terms, including the deal-split arrangement, the marketing budget requirement, the refund policy, and the attorney-review requirement. Where the Mentoring Agreement and this site conflict, the Mentoring Agreement controls.

Three-day cancellation. You may cancel within three business days of signing for a full refund. If you signed away from our regular place of business, you also hold statutory rescission rights under NRS 598.230. Nothing here waives those rights.

The program is not available to residents of the State of Utah.

4. Payment

Payments are processed by Square, subject to Square's own terms. We do not receive or store your full card details. Charges may appear on your statement under our merchant name rather than "Win on Terms."

5. Intellectual property

All content on this site and in the program — text, materials, templates, contracts, checklists, and recordings — is protected and is licensed to enrolled students for their own personal business use only. You may not share, republish, resell, or distribute it, or use it to build a competing educational program.

6. No advice; independent professionals required

Nothing here is legal, tax, accounting, or financial advice. You must retain your own licensed professionals. See the Disclaimer, which is incorporated into these Terms.

7. No guarantee

No income or result of any kind is promised or guaranteed. See the Disclaimer.

8. Your responsibilities

Comply with all laws in every state where you operate, including wholesaling disclosure, registration, and licensing requirements
Obtain attorney approval of your contracts before contracting on any property, per state
Comply with the TCPA, state mini-TCPA statutes, the National Do Not Call Registry, and 10DLC registration for all outbound calling and texting
Comply with fair housing law in all marketing
If you hold a real estate license — active or inactive — comply with all licensee disclosure obligations, including NAC 645.640 in Nevada

9. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of your use of this site is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or lost-profit damages.

10. Governing law and disputes

These Terms are governed by the laws of the State of Nevada. Venue is Clark County, Nevada. Disputes arising from the Mentoring Agreement are subject to the arbitration and class-waiver provisions of that agreement.

11. Changes

We may update these Terms. Changes apply going forward and do not alter any signed Mentoring Agreement.
